Terms of Service

These Terms of Service ("Terms") govern your use of the website at reprisereviews.com and the services provided by RepRise ("we," "us," or "our"). By using our website or services, you agree to these Terms. If you use them on behalf of a business, you confirm that you have authority to bind that business.
1. The services
RepRise provides software and services that help businesses request customer reviews and feedback by text message and email, collect survey responses, and report on the results. If you have a separate written agreement or order form with RepRise, that agreement controls where it conflicts with these Terms.
2. Your responsibilities
- Provide accurate information and keep your account details current.
- Use the services only for lawful purposes and only to contact customers who have given you permission to be contacted by text or email, as required by laws and rules such as the Telephone Consumer Protection Act, the CAN-SPAM Act, state laws, and mobile carrier requirements.
- Honor opt-out requests promptly. Anyone who replies STOP must not be contacted again by text until they opt back in.
- Follow the rules of review platforms such as Google, including their policies on fake, incentivized, and selectively solicited reviews.
3. SMS Program Terms
These terms apply to the text messages RepRise sends from its own number to people who have opted in on our website. Text messages that RepRise sends on behalf of a client business to that business's customers are governed by that business's own program terms.
- Program name: RepRise Account and Support Messages.
- What you will receive: onboarding and setup updates, demo and appointment reminders, replies to your inquiries, and account and support notices.
- Message frequency: varies, up to 6 messages per month.
- Costs: message and data rates may apply, depending on your mobile plan.
- Opt out: reply STOP at any time (STOPALL, UNSUBSCRIBE, CANCEL, END, and QUIT also work). You will receive one confirmation message and then no further messages. Reply START to opt back in.
- Help: reply HELP, or contact us at support@reprisereviews.com.
- Carriers: wireless carriers are not liable for delayed or undelivered messages.
- Consent: agreeing to receive texts is not a condition of purchasing any goods or services.
- Privacy: see our Privacy Policy for how we handle your information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
4. Acceptable use
You may not use the services to send unlawful, deceptive, harassing, or unsolicited messages, to post or solicit fake reviews, to interfere with or disrupt the services, or to access them in an unauthorized way.
5. Intellectual property
RepRise and its licensors own the services, website, and related materials. You may not copy, modify, or resell them without our permission. You keep ownership of the content and customer information you provide, and you give us the right to use it as needed to provide the services.
6. Third-party services
The services rely on third-party providers, such as Google and Twilio. Their availability and terms are outside our control, and your use of their services may be subject to their own terms.
7. Disclaimers
The website and services are provided "as is" and "as available." To the fullest extent permitted by law, RepRise disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any particular number of reviews, ratings, or results.
8. Limitation of liability
To the fullest extent permitted by law, RepRise will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising from your use of the services. Our total liability for any claim relating to the services will not exceed the amount you paid RepRise in the three months before the claim arose.
9. Indemnification
You agree to indemnify RepRise against claims and expenses arising from your use of the services in violation of these Terms or applicable law, including claims about messages sent to people who had not given consent.
10. Termination
You may stop using the services at any time. We may suspend or end access if you violate these Terms or if we need to protect the services, our users, or others.
11. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Maricopa County, Arizona.
12. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page and change the effective date above. Continued use of the services after an update means you accept the updated Terms.
